We all know that that the motor vehicle amendment act came into existent in September 2019. These new traffic rules come with many more strict regulations to follow. This act begins with much more penalties and more stringent for violation of any specific road law.
A list of expensive traffic fines is being imposed on vehicle users. Last month has been a month of disasters for commuters. Challans are amounting around Rs. 23000 for traveling via Scooty, Rs.35000 for the motorbike users, Rs. 59000 for the tractor users. Apart from this list, around Rs.6.5 lakhs of challan have been incurred from the truck drivers in Odisha.
The travelers are making quiet, cautious moves regarding the commuting methods on roads. They are all well aware of the traffic fines. In the meantime; many commuters are very much concerned with e-challan. The factor of e challan is that the individual never gets the chance to know the traffic fine immediately. However, the traffic police will not seize the vehicle paper or the vehicle of the commuter.
This form of the situation gives rise to so many questions for the commuters-for instance of how one commuter can check whether he has been given an e-challan or not? or how to pay challan online? What will be consequences if challan is not submitted on time? Or any other questions such as the concerned transport department along with the police are liable to incur any fine? Well, we are here with the questions you worry most about the reference to e-challan. So, without any further wasting your time, let us get into it-
- Insurance can be expensive:
If the vehicle owner fails to provide outstanding fine, then the vehicle insurance is used to cover the traffic fine. It shows that when you go for renewing the coverage for your vehicle the next time, you might receive the pending invoice from the e-challan. Another thing is that, if your vehicle lacks insurance, you are supposed to face a lot of difficulties while selling the vehicle.
As per a report based on the IRDA (Regularity Insurance Authority of India), it shows that IRDA came with the notion of working on the above project that linking fines with the vehicle insurances. The implementation of this act will be first seen in our capital state. If the process of linking goes successful, then this same method will be followed all across the country.
- Court visit:
One is about to visit court if the individual fails to submit these challans on time. Therefore, the vehicle owner is bound to attend the court for settling the matter. However, on spot challans are even sent to courts. The traffic police send them after some period.
- Traffic police and their role:
The traffic police don’t have the right to recover any form of fine from the commuters., an individual poses the right to reject the fine paid directly to the traffic police. One can even pay the fine to the traffic police. The traffic police do not have the power of forcefull payments. The only duty of traffic police is to stop the individual who mistakenly violates the traffic rules. Other than stopping, one can give the commuter the challan concerning the traffic violation. The court is supposed to launch order for recovering traffic fines. Only after this process, the police can go for recovering actions.
4 Imprisonment:
When one commuter receives on spot challan, the vehicle document/ Driver’s license is taken in by the traffic police. After that, the concerned commuter needs to visit the court. In some cases, the commuter can arrange other papers related to the vehicle. In those cases, the driver often rejects attending the court. In those scenarios, the court calls for the concerned individual. Another scene concerning this situation is that the court might launch a non-bailable warrant for the commuter. For facing this kind of stressful situation, one might have to face the legal authorities more ruthlessly. A hefty fine may be imposed against the commuter. Other than this, imprisonment of the commuter is also viable. Therefore, to avoid making the situation complicated, try going for the secure method. Visit the court when you are asked the first time.
