Parliament passed the new motor Motor Vehicles Bill recently. It became effective from September 1, 2019. The act showcases that a huge loss will be incurred against the violation of traffic rules.
A notification by Transport ministry issued on August 28 explained all the significant changes in the new Motor Vehicles Bill of September 2019.
Here are all the new rules under the Motor Vehicles Bill:
- Enhancement of the penalties:
The new act has been designed with enhanced penalties with any form of a traffic violation. We are about to have an explanation regarding the changes in the motor vehicle act. It is as per the transport ministry press release.
Now let us have a look at the other penalties:
New penalty amounts under Motor Vehicles Amendment Act, 2019 from September 1st
i) Penalty for offenses where no penalty is expressly provided: The old charges were Rs. 100 and Rs 300 in case any second, as well as subsequent traffic fines. The new traffic goes as such- Rs. 500 for the first time, while Rs.1500 for second along with the following violation charges.
ii) Violation of road regulation: It is a new segment here. There is a traffic parameter that came with the traffic fine, Rs 500 for the first time. While for the second along with subsequent times are-Rs. 1000.
III) Traveling without a ticket: The old amount in this segment were Rs. 200. while the new amount in this segment is-Rs. 500.
V) Disobedience of legal orders and refusal to share information: The new traffic fine is Rs. 2000. The old traffic fine in this segment was Rs. 500.
Vi) Unauthorized use of vehicles without a license: The old traffic fine in this segment was Rs. 1000 and the new traffic fine here is Rs. 2000.
Vii) Driving without a license: Here is a drastic change in the fine range. The old fine, however, was Rs. 500. While the new one is Rs. 5000.
Vii) Driving despite disqualification: Well, here is another drastic fine hike. The old fine was Rs. 500 while the new one is Rs. 10000.
Viii) Over speeding: The old traffic fine in this segment was Rs. 400. The new traffic varies from vehicle to vehicle. For LMV, the traffic fine is somewhere around Rs. 1000- 2000. For medium passenger any goods vehicle, the traffic fines are somewhere around Rs. 2000- 4000. Also impounding of driving licenses for second along with subsequent times.
iX) Dangerous driving: Previously, there were no charges. But with recent enhancements imprisonment for six months to 1 year or a traffic fine of Rs. 1000 to Rs 5000 for the first-time lawbreaker. For the second, along with subsequent times, imprisonment for around two years or a fine of Rs. 10000.
X) Drunken driving: Again, there was nothing for this segment. This motor vehicle bill 2019 came out with imprisonment for up to 6 months or a fine of 10000 for the first-time lawbreakers. And for the second timers, imprisonment up to 2 years or a traffic fine of Rs. 15000.
Xi) Driving while physically unfit: The old segment showcases Rs 200 for the first time total Rs. 500 for the second time. The new segment showcases Rs. 1000 for first-timers while for second and subsequent times Rs. 2000.
Xii) An offense relating to the accident: Traffic fine around Rs.5000 or imprisonment serving of 6 months. For second and subsequent timers up to 1 year or a fine of Rs. 10000.
Xiii) Racing and speeding: Imprisonment around one month or a traffic fine of 500. And for second along with subsequent times, imprisonment for one month or a traffic fine of Rs. 10000.
Xiv) Driving uninsured vehicle: The old traffic fine punishment for up to 3 months or a fine of Rs. 1000 or the new traffic rules show that a traffic fine of Rs. 2000 or imprisonment of 3 months for the first-timers. For the second timers and subsequent times traffic fine of Rs.4000 or serving an imprisonment of 3 months.
Xv) Taking a vehicle without legal authority and seizing vehicle by force: The traffic fine now is Rs. 5000/-. The old traffic fine in this segment was Rs.500.
Xvi) Obstructing the free flow of traffic: The old traffic fine was Rs. 50 while the new penalty is Rs. 500.
